The Organic Law 1/2015 of 30th March establishes the responsibility of the administrators of a business for offences which are committed within the business, either by its legal representatives or by its employees, if there was a lack of due supervision or control over them.
In the same law, an exemption is introduced if, before a crime is committed, the administrative body has adopted and effectively implemented models for the organisation and management of legal compliance. These management systems must include suitable monitoring and control measures in order to prevent or significantly reduce the risk of offences from being committed. In order to demonstrate this diligence, companies can implement compliance management audits and certificates through an independent third party.

Our aim is to offer evidence which will provide the judicial body with an additional factor when evaluating whether the compliance model meets legal requirements (article 31 Bis. 5. 6th, as indicated in Circular 1/2016 about the criminal liability of legal entities in accordance with the criminal code brought into force by the organic law 1/2015).
